The statute “is silent with regard to delta-8 THC,” the court stated in its 3-0 decision.

The 2018 Farm Bill’s language explicitly clarifies a distinction between Cannabis sativa, which is high in THC and used to make marijuana, and “industrial hemp” plants, which are significantly lower in THC and used to create a wide range of hemp-derived goods. Because of this distinction, hemp-derived goods are less regulated on the federal level than marijuana, which is more heavily restricted for recreational and medical usage.

To make the state legislation appropriate to their constituents, each state’s governing body may choose to interpret the statute with some minor changes or completely differently. Due to these differences, each state has the choice of regulating all cannabinoids, some cannabinoids, only THC, or in rare situations, particular isomers of THC like Delta-8 or Delta-9 THC. Any state where Delta-8-THC is legal allows its sale in stores and online. The minimum age for purchasing Delta-8-THC products is typically 21, though this may change in some circumstances. For instance, because North Carolina abides by federal regulations. So, it is legal to trade, possess, and consume cannabinoids derived from hemp, including CBD, delta 8 THC, and other cannabinoids. The only limitation in force pertains to minors buying and using delta 8 THC. Before a sale is completed, businesses must confirm the customer’s age, and it is against state law for anybody under 21 to buy cannabis. 

Many of the products like gummies look like candies and end up attracting kids, but they contain a derivative of the active element in marijuana called Delta-8 THC, which can produce a mild high.
